RESOLUTION NO. 91- 46 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO ENTER INTO AN AGREEMENT WITH <br />MANSOUR, GAVIN, GERLACR & MANOS CO., L.P.A., <br />FOR LEGAL SERVICES IN RESPECT TO LITIGATION <br />INVOLVING THE PARRVIEW GOLF COURSE AND <br />DECLARING AN EMERGENCY <br />WHEREAS, the Mayor and Council have expressed an interest <br />in the purchase of the Parkview Golf Course for purposes of a <br />Municipal golf course; and <br />WHEREAS, Mayor Fred N. Carmen, present Council members, <br />Santo Basile and Lawrence Flynn, and former Council members David <br />Petschauer, George Goley and Richard C. Etzler, have been named <br />Defendants in Patrick LaConte, et al. v. Santo Basile, et al., <br />the same being Case No. C 90-0972, filed in the United States <br />District Court for the Northern District of Ohio, Eastern <br />Division; and <br />WHEREAS, the Law Director, pursuant to Article V, Section <br />4, of the Charter of Mayfield Village, Ohio, has certified to the <br />Mayor and Council that he is unable to represent the parties in <br />such matter; and <br />WHEREAS, in order to promote economy, efficiency and <br />orderly representation of the Village, it is desirable to retain <br />Mansour, Gavin, Gerlack & Manos Co., L.P.A. as special counsel; <br />and <br />WHEREAS, .The Mayor and Council have further determined that <br />it is in the best interest of the Village as well as the Public <br />Officials in their performance of their duties to retain the <br />services of outside legal counsel. <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Mansour, Gavin, Gerlack & Manos Co., L.P.A., <br />is hereby employed as special counsel in representing Mayfield <br />Village in the acquisition of the Parkview Golf Course and in the <br />
