RESOLUTION NO. 91-69 INTRODUCED BY: Mayor Carmen and Council as a Whole A RESOLUTION AWARDING A CONTRACT TO BROWNING FERRIS INDUSTRIES A3 LOWEST AND BEST BIDDER FOR SOLID WASTE REMOVAL AND RECYCLING IN HAYFIELD VILLAGE, OHIO, REJECTING ALL OTHER BIDS AND DECLARING AN EMERGENCY BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1: In accordance with bids received, pursuant to advertisement as required by law, Browning Ferris Industries is hereby declared to be the lowest and best bidder for solid waste removal and recycling in Mayfield Village, Ohio. SECTION 2. The Mayor and President of Council are hereby authorized and directed to execute a contact with Browning Ferris Industries for solid waste removal and recycling within the Municipality from August 1, 1991, through July 31, 1993, in the amount of .Twelve Dollars and Forty-Four Cents ($12.44) per home. The Contract awarded shall be in a form approved by the Director of Law, in accordance with the specifications upon which the bid was received. . SECTION 3. All other bids received are hereby rejected. SECTION 4. The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 5. This Resolution is hereby declared to be an emergency measure for the immediate preservation for the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason that the Contract awarded herein is necessary to maintain effective governmental services. It shall, therefore, take effect immediately upon the passage by the affirmative vote
