RESOLUTION NO. 91-69 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />AWARDING A CONTRACT TO <br />BROWNING FERRIS INDUSTRIES <br />A3 LOWEST AND BEST BIDDER FOR SOLID WASTE REMOVAL <br />AND RECYCLING IN HAYFIELD VILLAGE, OHIO, <br />REJECTING ALL OTHER BIDS AND <br />DECLARING AN EMERGENCY <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1: In accordance with bids received, pursuant to <br />advertisement as required by law, Browning Ferris Industries is <br />hereby declared to be the lowest and best bidder for solid waste <br />removal and recycling in Mayfield Village, Ohio. <br />SECTION 2. The Mayor and President of Council are hereby <br />authorized and directed to execute a contact with Browning Ferris <br />Industries for solid waste removal and recycling within the <br />Municipality from August 1, 1991, through July 31, 1993, in the <br />amount of .Twelve Dollars and Forty-Four Cents ($12.44) per home. <br />The Contract awarded shall be in a form approved by the Director <br />of Law, in accordance with the specifications upon which the bid <br />was received. . <br />SECTION 3. All other bids received are hereby rejected. <br />SECTION 4. The Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, <br />resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised <br />Code. <br />SECTION 5. This Resolution is hereby declared to be an <br />emergency measure for the immediate preservation for the health, <br />safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reason that the Contract awarded herein is necessary to <br />maintain effective governmental services. It shall, therefore, <br />take effect immediately upon the passage by the affirmative vote <br />
