M.V. Resolution No. 91 -86 <br />Page 2 <br />SECTION 2. Council hereby confirms the permit and approval <br />recommended by the Planning and Zoning Commission of Mayfield <br />Village on October 7, 1991 to Mayfield United Methodist Church, <br />to operate a Mother's Day Out Program as a Special U-6 Use Permit <br />upon the premises, subject to the conditions hereinafter set <br />forth. <br />SECTION 3. The Special Use Permit granted herein is subject <br />to the following terms and conditions: <br />A. Such premises shall be inspected on an annual basis by <br />the Building and Fire Inspectors. <br />B. The Permit granted herein shall be effective only as <br />long as the Mayfield United Methodist Church remains as the <br />operator of such a program. <br />C. An appropriate barrier, i.e. fence, shall be constructed <br />around the outdoor play area subject to the approval of the <br />Architectural Review Board: <br />D. The Permittee shall erect signs on the property subject <br />to the approval of the Building Inspector and the Architectural <br />Review Board. <br />E. This Permit may be revoked for any period of time or <br />revoked by the Planning and Zoning Commission upon ten (10) days <br />written notice and hearing for any one or more of the following <br />reasons: <br />(1) Failure to comply with any laws or ordinances <br />applicable to the business and operation of a day care <br />center; <br />(2) Failure to pay any taxes due to Mayfield <br />Village in connection with the business of the <br />Permittee. <br />(3) Operation of the business authorized by the <br />Permit in a manner determined by the Planning and <br />Zoning Commission to be detrimental to the health, <br />safety, morals or welfare of the residents of Mayfield <br />Village or in such a manner as to constitute a <br />nuisance, or permitting the grounds or buildings to <br />become unsafe or unsightly; <br />SECTION 4. The Permittee shall have no more than ninety <br />(90) days to comply with any violation of the terms and <br />conditions set forth hereinabove, said ninety (90) day period to <br />commence after the Permittee receives written notice from the <br />municipality of such violation. <br />
