INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING SECTION 521.12 OF THE CODIFIED ORDINANCE3 <br />OF MAYFIELD VILLAGE, OHIOe PERTAINING TO COLLECTION <br />AND TRANSPORTATION OF SOLID WASTE, <br />REPEALING ALL ORDINANCES INCONSISTENT HEREWITH AND <br />DECLARING AN EMERGENCY <br />BE IT ORDAINED BY,THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Section 521.13 of the Codified OrdinanceS of <br />Mayfield Village, Ohio is hereby enacted to read as follows: <br />Chapter 521 <br />Health, Safety and Sanitation <br />? * * <br />521.13 COLLECTIONS AND TRANSPORTATION OF SOLID WASTE. <br />(a) No person owning or driving a vehicle hauling <br />solid waste shall cause the collection, <br />transportation or transfer of such waste other <br />than between the hours of 6:00 A.M. and 7:00 P.M. <br />(b) No collection, transportation or transfer shall <br />occur on Saturday after 4:00 P.M. or on Sundays. <br />(c) Application for exceptions to this provision may <br />be made to the Chief of Police, on a form provided <br />by the Police Department: Such exception shall be <br />granted only where the applicant is able to <br />demonstrate circumstances of great practical <br />difficulty and the collection and transportation <br />of solid waste in areas where there is a heavy <br />daytime vehicular and pedestrian traffic and a <br />concentration of commercial activity. <br />(d) Whoever violates any provision of this Section <br />shall be guilty of a misdemeanor of the fourth <br />degree. <br />SECTION 2. All prior Ordinances inconsistent with this <br />Ordinance, in whole or is part, are repealed to the extent <br />necessary to avoid conflict with this Ordinance.
