AS AMENDED 5/21/91 <br />ORDINANCE NO. 91-18 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />GRANTING A VARIANCE TO HEINENI3, INC. <br />FOR THE PURPOSE OF MAINTAINING THE SIGNS <br />ON CERTAIN PROPERTY LOCATED <br />AT 860 S.O.M. CENTER ROAD AND <br />DECLARING AN EMERGENCY <br />WHEREAS, on July 21, 1985, Mayfield Village Council enacted <br />Ordinance No. 85-16 which required that all commercial signs must <br />be in compliance with the Codified Ordinances within five (5) <br />years; and <br />WHEREA3, Heinen's presently has two (2) signs on the <br />premises known as 860 S.O.M. Center Road that would be in <br />violation of Section 1185.14 of Mayfield Village Codified <br />Ordinances; and <br />WHEREA3, Heinen's, Inc. has requested a variance in order <br />to maintain the height of the signs on such property; and <br />WHEREAS, the Building Commissioner has reviewed the height <br />of such signs and has given his recommendation that Heinen's, <br />Inc. should be granted a variance in order to maintain the signs <br />presently at their current height; and <br />WHEREAS, the Planning and Zoning Commission on May 6, 1991, <br />after reviewing Lieutenant Jack Jay's report in respect to <br />traffic safety, recommended to Council to grant such variance; <br />and <br />WHEREAS, to avoid unreasonable hardship to theeproperty <br />owner, Council is desirous to grant a variance to Heinen's, Inc. <br />to allow the present signs at its current height; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Heinen's, Inc. is hereby granted a variance <br />for the signs to be located at 860 S.O.M. Center Road, so as to <br />maintain its present signs at its current height.
