Permanent Parcel Nos. 831-05-066, 831-07-001 and 831-07-002 Section 2e This Council finds that the appropriation is necessary for the stated public purpose of establishing a park, in- cluding a municipal golf course, and that the Village of Mayfield has been unable to agree with the owners of the property. Section 3. Special Counsel Michael T. Gavin and the Direc- tor of Law are directed to file a Petition for Appropriation in a court of competent jurisdiction, to have a jury impaneled to assess the compensation to be paid for the property. Section 4. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that delibera- tions of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. Section 4. This Ordinance is hereby declared to be an , emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reasons stated in the preamble hereof. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law. ^ Passed the _ First Reading: Second Reading: Third Reading: PASSED: ?
