V 'ORDINANCE N0.2013-07 <br />r <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING <br />THE MAYOR AND PRESIDENT OF COUNCIL <br />TO ENTER INTO A PURCHASE AGREEMENT <br />WITH GOVERNOR'S VILLAGE, LLC <br />WHEREAS, Governor's Village, LLC currently owns and operates an assisted living facility <br />known as governor's Village, (the "Facility") at 280 N. Common Blvd. in Mayfield Village, Ohio; <br />and <br />WHEREAS, Governor's Village, LLC wishes to expand its current operations, (the <br />"Expansion"); and <br />WHEREAS, Governor's Village has reviewed its current site and determined that additional <br />land is necessary to accommodate the Expansion of its Facility; and <br />WHEREAS, Governor's Village wishes to acquire a 1.11 acre parcel of land owned by <br />Mayfield Village located adjacent to and abutting its current property upon which its current Facility <br />is operated to accommodate the Expansion; and <br />WHEREAS, such land is depicted on Exhibit "A", to the Purchase Agreement (the <br />"Property"); and <br />WHEREAS, the Property is no longer necessary for municipal purposes and has been <br />appraised by a qualified appraiser; and <br />WHEREAS, the appraised value of the property is $4500.00; and <br />WHEREAS, Mayfield Village wishes to sell the Property to Governor's Village, LLC, in <br />accordance .its power of local self-government granted by Article XVIII of the Ohio Constitution and <br />without the need of advertising and competitive bidding, to spur economic and community <br />development in the Village. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL, OF HAYFIELD VII,LAGE, <br />OHIO, THAT: <br />SECTION 1. The Mayor and President of Council are hereby and herein authorized and <br />directed to enter into the Real Estate Purchase Agreement with Governor's Village, LLC a copy of <br />which is attached hereto and incorporated herein by reference as Exhibit "1" to sell the Property in <br />accordance with the Village's power of local self government granted by Article XVIII of the Ohio <br />Constitution and without the need of advertising and competitive bidding. . <br />
