A decision by the Board of Zoning Appeals in response to an application for a variance request <br />or an appeal of an administrative decision filed pursuant to this regulation shall be final, unless <br />appealed to Mayfield Village Council per Codified Ordinance Section 1105.02(d). <br />1127.12INSPECTION OF RIPARIAN SETBACKS <br />The identification of riparian setbacks shall be inspected by Mayfield Village: <br />A. Prior to soil disturbing activities authorized under this regulation. The applicant shall provide <br />Mayfield Village with at least two (2) working days written notice prior to starting such soil <br />disturbing activities. <br />B. Any time evidence is brought to the attention of Mayfield Village that uses or structures are <br />occurring that may reasonably be expected to violate the provisions of this regulation. <br />1127.99PENALTY <br />A. Any person who. shall violate any section of this regulation shall be guilty of a misdemeanor of <br />first degree and, upon conviction thereof, shall be subject to punishment as provided in the Ohio <br />Revised Code and shall be required to restore the riparian setback through a restoration plan <br />approved by the Planning and Zoning Commission. <br />_ . B. The imposition of any other penalties provided herein shall not preclude Mayfield Village from <br />instituting an appropriate action or proceeding in a Court of proper jurisdiction to prevent an <br />unlawful development, or to restrain, correct, or abate a violation, or to require compliance with <br />the provisions of this regulation or other applicable laws, ordinances, rules, or regulations, or the <br />orders of Mayfield Village. <br />11 <br />
