J ORDINANCE N0.2013-13 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE TO AMEND AND SUPPLEMENT THE CODIFIED,ORDINANCES OF HAYFIELD VILLAGE, OHIO BY AMENDING SECTIONS 505.11 AND 505.13 RELATING TO DANGEROUS, NUISANCE AND VICIOUS DOGS AND ENACTING CODIFIED ORDINANCE SECTION 505.131 REGULATING THE MAXIMUM NUMBER OF DOGS PERMITTED; PRIOR ACQUISITION NOT AFFECTED. WHEREAS, after review by the Village's Ordinance Review Committee, and in light of certain changes implemented by the State of Ohio per HB 14 to Ohio's Vicious Dog statute and consultation with the Village's Police Chief, it is the recommendation of the Ordinance Review Committee that Codified Ordinance Sections 505.11 and 505.13 be amended and new Codified Ordinance Section 505.131 be enacted; WHEREAS, the amendments to the Codified Ordinance Sections and the enactment of the new Codified Ordinance Section will bring the Village's Ordinance regulating dangerous, nuisance and. vicious dogs in line with Ohio's Vicious Dog statute; WHEREAS, breed specific provisions have been eliminated and new penalties have been tied to specific behavior; definitions of dangerous and vicious dogs have been modified and anew definition of a nuisance dog has been added; and WHEREAS, Village Council deems it in the best interest of the Village and its residents to amend Codified Ordinance Sections 505.11 and 505.13 and to enact new Codified Ordinance Section 505.131, as recommended by the Ordinance Review Committee. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Codified Ordinances of Mayfield Village, Ohio are hereby supplemented by amendment to Sections 505.11 and 505.13 and the enactment of new Section 505.131, to read as more fully set forth in Exhibit "A", ,attached hereto and incorporated herein by reference. SECTION 2. All other provisions of the Village's Codified Ordinances not inconsistent herewith shall remain in full force and effect.
