,~ <br />ORDINANCE N0.2013-21 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />ACCEPTING THE TRANSFER AND DONATION OF <br />CERTAIN REAL ESTATE LOCATED AT <br />734 SOM CENTER ROAD FROM THE <br />OHIO DEPARTMENT OF TRANSPORTATION. <br />WHEREAS, on or about August 9~', 2012, the Ohio Department of Transportation ("ODOT") <br />determined to relocate its highway maintenance facility in Mayfield Village to a new facility in the <br />City of Euclid; and <br />WHEREAS, ODOT made this determination since the Mayfield Village property, being <br />constrained in size, no longer met ODOT's operation requirements to efFciently maintain Interstate <br />and State Highway Systems in this portion of Cuyahoga County; and <br />WHEREAS; as a result of the relocation and vacation of the property, ODOT determined that <br />the property is no longer needed for their use for future highway or other purposes; and <br />WHEREAS, ODOT has offered to transfer and donate the property to Mayfield Village, at <br />no cost, for the Village's use so long as the property is retained by the Village for non-residential <br />public or governmental use only; and <br />WHEREAS, the Village wishes to accept the transfer and donation of the property located at <br />734 SOM Center Road from ODOT as outlined above. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. Village Council hereby accepts the transfer and donation of the real estate <br />located at 734 SOM Center Road, in Mayfield Village, Ohio in accordance with the provisions <br />outlined above and in the Director's Deed, a copy of which is attached hereto and incorporated <br />herein as Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal actions of this Council relating <br />to the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121..22 of the Ohio Revised Code. <br />
