ORDINANCE N0.2012-06 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING ORDINANCE 2010-38 <br />RELATING TO THE AGREEMENT WITH <br />THE BOARD OF TRUSTEES OF THE <br />CUYAHOGA COUNTY PUBLIC LIBRARY. <br />WHEREAS, the Village and the Board of Trustees of the Cuyahoga County Public Library <br />("Library') entered into a Purchase Agreement, in concept, on September 20, 2010; and <br />WHEREAS, although the principal terms of the Agreement remain substantively the same, a <br />number of clarifications, updates and required modifications have occurred since then as the <br />development plan for the Library has gone through the formal approval process; and <br />WHEREAS, since September 20, 2010, the Village and Library representatives have <br />finalized the actual five (5) acre parcel to be donated, including certain easements and the means of <br />ingress and egress to the site, as well as the final site plan which has just been approved by the <br />Village's Planning and Zoning Commission at its February 6, 2012 meeting; and <br />WHEREAS, the specific clarifications, amendments and additions are set forth in the <br />Purchase Agreement attached hereto and incorporated herein as Exhibit "A", the most significant of <br />which are summarized as follows: <br />1) The Village commits to providing an Access Road from SOM Center Road to the <br />Property as outlined on the Library site plan attached hereto and incorporated herein <br />as Exhibit "B" and commits to an expenditure in an amount not to exceed One <br />Hundred and Seventy Five Thousand Dollars ($175,000) to design and construct the <br />Access Road; and <br />2) The Village commits to provide a traffic signal at the intersection of the Access <br />Road and SOM Center Road, at its cost, when and ifrequired, in accordance with and <br />subj ect to the requirements of the Ohio Manual of Uniform Traffic Control Devices; <br />and <br />
