ORDINANCE N0.2012-08 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR <br />TO ENTER INTO AN ACCESS EASEMENT AGREEMENT <br />WITH THE BOARD OF TRUSTEES OF THE <br />CUYAHOGA COUNTY PUBLIC LIBRARY ("LIBRARY") <br />AS AND FOR TI3E PURPOSES OF PARHING, INGRESS AND <br />EGRESS TO THE LIBRARY'S PROPERTY <br />WHEREAS, the Village of Mayfield desires to allow additional parking and ingress and <br />egress benefits to the Library's property; and <br />WHEREAS, certain property owned by the Village is required to facilitate such purposes; <br />and <br />WHEREAS, the Village has agreed to enter into an Access Easement Agreement with the <br />Board of Trustees of the Cuyahoga County Public Library allowing the use of such certain property <br />for these purposes. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. The Village of Mayfield hereby authorizes and directs the Mayor to enter into <br />an Access Easement Agreement whereby the Village has agreed to allow the Board of Trustees of the <br />Cuyahoga County Public Library the right to construct, maintain, patrol and use a certain part of their <br />premises for additional parking as well as for ingress and egress purposes as more fully set forth in <br />the Access Easement Agreement attached hereto and incorporated herein as Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately <br />necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, <br />therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) <br />
