ORDINANCE NO. 2011-23 <br />IlvTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CONFIRMING THE APPOINTMENT OF SPECIAL <br />COUNSEL TO REPRESENT THE VILLAGE <br />IN UPCOMING POLICE AND FIRE NEGOTIATIONS <br />AND ESTABLISHING THE TERMS, CONDITIONS, <br />AND COMPENSATION OF SUCH APPOINTMENT. <br />WHEREAS, the Mayor has appointed David J. Malty, as special counsel, pursuant to <br />Article V, Section 4 of the Village's Charter; and <br />WHEREAS, Council deems it necessary and in the best interest of the health, safety <br />acid welfare of all Village residents to confirm this appointment and establish the terms, <br />a~nditions and compensation for David J. Maty, as special counsel to handle labor <br />n~;gotiations with the Police and Fire Unions. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor's renewed appointment of David J. Malty, as special counsel <br />tc handle labor negotiations with the Police and Fire Unions, is hereby confirmed, effective <br />retroactively from January 1, 2011 subject to all applicable Village Ordinances and on the <br />s2rrie terms and conditions as set forth in the initial engagement letter attached to Ordinance <br />2009-50 dated September 29, 2009, a copy of which is also attached hereto and incorporated <br />herein as Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield Village, <br />Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of <br />
