ORDINANCE N0.2009-SO INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE CONFIRMING THE APPOINTMENT OF SPECIAL COUNSEL TO REPRESENT THE VILLAGE IN 3JPCOMING POLICE AND FIRE NEGOTIATIONS AND ESTABLISHING THE TERMS, CONDITIONS, AND COMPENSATION OF SUCH APPOINTMENT. WHEREAS, the Mayor has appointed David J. Malty, as special counsel, pursuant to Article V, Section 4 of the Village's Charter; and WHEREAS, Council deems it necessary and in the best interest of the health, safety and welfare of all Village residents to confirm this appointment and establish the terms, conditions and compensation for David J. Malty, as special counsel to handle labor negotiations with the Police and Fire Unions. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor's appointment of David J. Malty, as special counsel to handle the labor negotiations with the Police and Fire Unions for the remaining part of 2009 and, if necessary in 2010, is hereby eonfrrmed effective immediately, subject to all applicable Village Ordinances and to the terms, conditions and compensation hereinafter established and in accordance with the engagement letter attached hereto and incorporated herein as Exhihit "A". SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.
