ORDINANCE N0.2011-32 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AMENDING CODIFIED ORDINANCE SECTION 1363.02 DUMPING, DEPOSITING, STORAGE OF GARBAGE, RUBBISH, REFUSE PROHIBITED WHEREAS, it is the recommendation of the Ordinance Review Committee that all residents be required to store garbage receptacles out of site from any and all public streets and roadways; and WHEREAS, the Village Council deems it in its best interest to amend Codified Ordinance Section 1363.02 to include such requirement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Section 1363.02 of the Village's Codified Ordinances as enacted in 1973 per Ord. 73-19, and per the recommendation of the Ordinance Review Commission be amended to read as more fully set forth in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 2. All other provisions of the Village's Codified Ordinances not inconsistent herewith shall remain in full force and effect. SECTION 3. The Clerk of Council is authorized and directed forward a certified copy of this Ordinance to the Codifier of the Village of Mayfield. SECTION 4. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 5. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.
