I/ <br />ORDINANCE NO. 2010-35 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />REPEAI.ING IN ITS ENTIRETY <br />CURIdENT CIiAPTER 1125 - FLOOD HAZARD AREAS <br />AND ENACTING NEW CHAPTER 1125 - <br />SPECIAL PURPOSE FLOOD DAMAGE REDUCTION. <br />WHEREAS, Article XVIII, Section 3 of the Ohio Constitution grants municipalities the legal <br />authority to adopt land use and control measures for promoting the health, safety and general welfare <br />of its citizens; and <br />WHEREAS, the Village has special flood hazard areas that are subject to periodic inundation <br />which result in loss of life and property, health and safety hazards, disruption of commerce and <br />governmental services, extraordinary services, extraordinary public expenditures for flood protection <br />and relief, and impairment of the tax base; and <br />WHEREAS, additionally, structures that are inadequately elevated, floodproofed, or <br />otherwise protected from flood damage also contribute to flood loss; and <br />WHEREAS, Council finds it in the best interest of the health, safety and welfare of all <br />Village residents to minimize the threat of such damages and to achieve the purposes set forth in <br />Chapter 1125. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. Chapter 1125 - Flood Hazard Areas shall be repealed in its entirety and <br />replaced with new Chapter 1125 - Special Purpose Flood Damage Reduction as more fully set forth <br />in Exhibit "A" attached hereto and incorporated herein by reference. <br />SECTION 2. All other codified ordinances in sections not specifically repealed or amended <br />herein shall remain in effect unless inconsistent with this ordinance. <br />SECTION 3. The Clerk of Council is authorized and directed to forward a certified copy of <br />this ordinance to the Codifier of the Village of Mayfield. <br />SECTION 4. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code.
