ORDINANCE NO. 2009-01 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />ESTEIBLISHING A PUBLIC BIDDING PROCEDURE <br />FOR DESIGN-BUILD BIDS FOR CONSTRUCTION OF THE <br />VILLAGE'S NEW POLICE STATION. <br />WHEREAS, this Council has determined that the design-build method of performing <br />the construction of a new Village Police Station is the most appropriate method to obtain the <br />best quality, service, performance, efficiencies and price for the project; and <br />WHEREAS, this Council finds that the design-build process of public bidding set forth <br />in this Ordinance complies with the Village Charter and/or Ordinance provisions which <br />require that public improvements or purchases which exceed $10,000 in cost shall be made to <br />the lowest and best bidder after public advertising in a manner prescribed by the Council and <br />that this Council shall not be required to accept any bid. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor is hereby authorized to employ a design-build bidding <br />process for the construction of a new Village Police Station through a process whereby a <br />public request for proposals from bidders shall be made. Upon receipt of the proposals, the <br />Mayor shall make a recommendation to Council for the award of a contract to the lowest and <br />best proposal which shall be within the sole discretion of this Council as to the determination <br />of the "lowest and best." Council shall not be required to accept any bid proposal and may <br />reject any and all bid proposals. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its coinmittees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield Village, <br />Ohio.
