ORDINANCE NO. 2009-28 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE REPEALING IN ITS ENTIRETY CHAPTER 747 ENTITLED TRANSPORTATION OF RADIOACTIVE MATERIALS. WHEREAS, at this time, it has been deemed in the best interest of the health, safety and welfare of all Village residents to specifically repeal in its entirety Chapter 747 pertaining to The Transportation of Radioactive Materials. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Chapter 747 of the Codified Ordinances of the Village pertaining to the Transportation of Radioactive Materials, a copy of which is attached hereto and incorporated herein by reference as Exhibit "A", is hereby and herein repealed in its entirety, and shall solely cross reference State and Federal laws regulating the transportation of radioactive materials: Packaging & Transportation of Radioactive Materials - See Ohio R.C. Chapter 3748 and OAC 3701:1-50; and Packaging & Transportation ofRadioactive Material - See 10 CFR Part 71. SECTION 2. All other provisions of the Village's Codified Ordinances not inconsistent herewith shall remain in full force and effect. SECTION 3. The Clerk of Council is authorized and directed to forward a certified copy of this Ordinance to the Codifier of the Village of Mayfield. SECTION 4 The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
