ORDINANCE NO. 2009-37 <br />INTRODUCED BY: Mayor.Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT WITH THE <br />BOARD OF COUNTY COMMISSIONERS, <br />CUYAHOGA COUNTY, OHIO, <br />FOR THE SITE UPGRADE OF THE <br />CUYAHOGA COUNTY PUBLIC SAFETY <br />INTEROPERABLE COMMUNICATIONS PRIME SITE <br />LOCATED IN MAYFIELD VILLAGE. <br />WHEREAS, the purpose of this Agreement is to coordinate and identify activities, <br />procurement and services for the site grade of the Cuyahoga County Public Safety Interoperable <br />Communications Prime Site; and <br />WHEREAS, pursuant to the Agreement, Mayfield Village agrees that it will install the <br />additional prime site infrastructure at Cuyahoga County's sole expense which will enable Cuyahoga <br />County to utilize the system, as well as upgrade the Village's system. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCII, OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. The Mayor is authorized and directed to enter into an agreement between the <br />Board of Cuyahoga County Commissioners and Mayfield Village as set forth in Exhibit A attached <br />hereto and incorporated herein by reference, whereby Mayfield Village will facilitate certain <br />upgrades to the prime site infrastructure located in Mayfield Village which will be paid at Cuyahoga <br />County's sole expense on a reimbursement basis in an amount not to exceed $110,000. <br />SECTION 2. The Council finds and determines that all forinal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code.
