ORDINANCE NO. 2009-39 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGElvCY ORDINANCE <br />AiJTHORIZING AN AGREEMENT WITH THE <br />BOA1tD OF COUNTY COMMISSIONERS, CUYAHOGA COUleTTY, OHIO, <br />FOR FISCAL YEAR 2008 ASSISTANCE <br />TO FIREFIGHTEI2S GRANT PROGRAIVI <br />ADDRESSING LOCAL MATCH FUNDS. <br />WHEREAS, the County has allocated funding to the Regional Planning Unit known as <br />the Department of Justice Affairs, Public Safety Grant Administration, for the purpose of <br />providing local matching funds for State and Federal public safety initiatives as related to <br />improving radio coverage and interoperability throughout the County by establishing an 800 <br />MHz APCO Project 25 digital trunked communications system that will provide capability and <br />reliability for all public safety organizations within Cuyahoga County; and <br />WHEREAS, the Federal Emergency Management Agency has awarded the Fiscal Year <br />2008 Assistance to Firefighters Grant to the Village for the purpose of funding the <br />Interoperability Project, providing communications equipment and services for the Village's <br />fire services, conditioned upon local matching funds from the County through the Regional <br />Planning Unit for operation of the project. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor is authorized and directed to enter into an agreement <br />between the Board of Cuyahoga County Commissioners and Mayfield Village as set forth in <br />Exhibit "A" attached hereto and incorporated herein by reference whereby the parties set forth <br />their agreement as to the facilitation of the local matching funds in an amount not to exceed <br />$240,322. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield Village, <br />Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of
