ORDINANCE NO. 2009-39 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGElvCY ORDINANCE AiJTHORIZING AN AGREEMENT WITH THE BOA1tD OF COUNTY COMMISSIONERS, CUYAHOGA COUleTTY, OHIO, FOR FISCAL YEAR 2008 ASSISTANCE TO FIREFIGHTEI2S GRANT PROGRAIVI ADDRESSING LOCAL MATCH FUNDS. WHEREAS, the County has allocated funding to the Regional Planning Unit known as the Department of Justice Affairs, Public Safety Grant Administration, for the purpose of providing local matching funds for State and Federal public safety initiatives as related to improving radio coverage and interoperability throughout the County by establishing an 800 MHz APCO Project 25 digital trunked communications system that will provide capability and reliability for all public safety organizations within Cuyahoga County; and WHEREAS, the Federal Emergency Management Agency has awarded the Fiscal Year 2008 Assistance to Firefighters Grant to the Village for the purpose of funding the Interoperability Project, providing communications equipment and services for the Village's fire services, conditioned upon local matching funds from the County through the Regional Planning Unit for operation of the project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor is authorized and directed to enter into an agreement between the Board of Cuyahoga County Commissioners and Mayfield Village as set forth in Exhibit "A" attached hereto and incorporated herein by reference whereby the parties set forth their agreement as to the facilitation of the local matching funds in an amount not to exceed $240,322. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.
