ORDINANCE NO. 2009-47 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT BETWEEN <br />THE CUYAHOGA COUNTY DISTRICT BOARD OF HEALTH <br />AND MAYFIELD VILLAGE FOR <br />2010 PHASE II STORM WATER ACTIVITIES. <br />WHEREAS, Council has detertnined that flooding is a significant threat to the public health, <br />safety and welfare of Mayfield Village residents and public and private property in the Village, and <br />storm water quantity control lessens flood damage by holding runoff and releasing it slowly over <br />time; and <br />WHEREAS, to promote the public health, safety and welfare along with sound economic <br />development in Mayfield Village, it has been deemed important to provide homeowners, developers <br />and land owners with consistent, technically feasible; and operationally practical standards for storm <br />water management; and <br />WHEREAS, the United States Code of Federal Regulations at 40 C.F.R. Parts 9, 122, 123, <br />and 124 referred to as the NPDES Storm Water Phase II, mandates that designated communities, <br />including Mayfield Village, develop a Storm Water Management Program to address the quality of <br />storm water runoff during and after soil disturbing activities; and <br />WHEREAS, Mayfield Village has adopted and implemented a Storm Water Management <br />Program; and <br />WHEREAS, to facilitate the Village's compliance with its NPDES Permit for stormwater, <br />Council deems it in the best interest of all Village residents to enter into an agreement with the <br />Cuyahoga County District Board of Health for the Board to perform certain duties and <br />responsibilities, including but not limited to, the inspection of all designated MS4 outfall locations <br />and sample up to 25 outfall locations for fecal coliform on an annual basis. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That the Mayor and President of Council are authorized and directed to enter <br />into an agreement with the Cuyahoga County District Board of Health, as more fully set forth in <br />Exhibit "A" attached hereto and incorporated herein. <br />?'
