ORDINANCE NO. 2009-54 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AMENDING <br />CODIFIED ORDINANCE CHAPTER 1523 RELATING TO <br />THE RECOVERY OF COSTS FOR EMERGENCY SERVICES <br />PROVIDED TO NON-RESIDENTS. <br />WHEREAS, it has been determined that Emergency Medical Services ("EMS") <br />provided by 1Vlayfield Village to non-residents in the year 2009 account for approximately <br />forly percent (40%) of all calls; and <br />WHEREAS, residents of Mayfield Village, and employees of Mayfield Village and <br />their dependents, pay taxes to Mayfield[ Village in the form of real estate taxes and other taxes <br />which at present are considered as full payment for any emergency medical services provided; <br />and <br />WHEREAS, since non-residents do not pay these taxes to Mayfield Village in the form <br />of real estate taxes, it has been deemed in the best interest of the Village to implement a <br />l` p"rocess to recover the costs for providing emergency services to such nori-residents, and non- <br />residents only. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Chapter 1523, Recovery of Costs for Emergency Medical Services <br />Provided To Non-Residents, shall be amended to read as set forth in Exhibit "A" attached <br />hereto and incorporated herein by reference and shall be effective upon passage. <br />SECTION 2. FurEhertnore, the Village has determined that the actual cost per run to be <br />charged in accordance with new Codified Ordinance Chapter 1523 shall be Twelve Hundred <br />Dollars ($1,200.00) per rt:n for the year 2009. This number shall be reviewed on an annual <br />basis and adjusted accordingly. <br />SECTION 3. The Clerk of Council is authorized and directed to forward a certified <br />copy of this Ordinance to the codifier of Mayfield Village and to the Village's insurance <br />billing service. <br />, SECTION 4. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the 'public, in compliance with all statutory requiremerits <br />including the requirements of Section 121.22 of the Ohio Revised Code.
