ORDINANCE NO. 2009-69 <br />PAGE 2 <br />SECTION 3. All other provisions of the Section and the Village's Codified <br />Ordinances not inconsistent herewith shall remain in full force and effect. <br />SECTION 4. It is the desire of Council that the ballots presented to the electors of <br />the Village be in substantially the following form: <br />A majority affirmative vote is necessary for passage. <br />Shall the ordinance providing for an additional 0.5 % increase in the <br />current levy on income, to a rate of 2.0%, effective July 1, 2010, for the <br />purpose of providing funds for maintaining municipal operation, services, <br />facilities and capital improvements, including the payment of debt service on <br />bonds, notes, loans or other obligations issued or incurred by the Village, be <br />passed? <br />FOR THE 1NCOME TAX <br />AGAINST THE INCOME TAX <br />SECTION 5. The Clerk of Council be and is hereby directed to file of a copy of this <br />Ordinance with the Board of Election of Cuyahoga County no later than February 18th, 2010. <br />This Council requests that the Board of Elections give notice of the election and prepare the <br />necessary ballots and supplies for the election in accordance with law. <br />SECTION 6. That in the event the foregoing amendment to section 175.0501 of the <br />Codified Ordinances is approved by a majority of the electors voting thereon, effective as of <br />12:01 A.M., July l, 2010, Section 175.0501 of the Codified Ordinances of Mayfield Village, <br />Ohio is herein and hereby repealed and reenacted as set forth herein, and henceforth all section <br />of Chapter 175 of the Codified Ordinances of Mayfield Village shall be interpreted to include <br />the changes made herein; provided, however, that no provision of this Ordinance, including <br />the repeal of the provisions referred to herein shall in any way affect any rights or obligations <br />of the Village, any taxpayer, or any other person, official or entity, with respect to the <br />Municipal Income Tax authorized by said section prior to the amendment. <br />SECTION 7. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code.
