ORDINANCE NO. 2009-70 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE ALTTHORIZING THE MAYOR TO ENTER I11eTTT0 A MEMORANI)UM OF UNDERSTANDING WITH CUYAHOGA COUNTY, OHIO, FOR THE PURCHASE OF A VOICE OVER IleTTERNET PROTOCOL ("VOIP") PHONE SYSTEM FOR THE VILLAGE. WBEREAS, the County and the Village desire to enter into an Agreement regarding the basic terms and conditions upon which the County will provide to the Village a Voice Over Internet Protocol ("VOIP") Phone System (hereinafter the "Project"); and ' WI3EREAS, the Project will consist of an extension ofthe Cuyahoga County, Ohio VOIP phone system ("Phone System") to the Village and provide the Village the ability to gain access to phone service and dial tone. The costs to operate the Phone System will be the true and actual costs of the service as charged to the County and passed through to the Village and will not contain any margin of profit. ? NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor is authorized and directed to enter into a Memorandum of Understanding between Cuyahoga County, Ohio and Mayfield Village in a form substantially similar to that as set forth in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.
