RESOLUTION NO. 2002- 04 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />GRANTING A SPECIAL USE PERMIT ALLOWING <br />MEDICAL OFFICES IN THE ENTIRE BUILDING <br />LOCATED AT 730 SOM CENTER ROAD, KNOWN AS <br />THE GEORGIAN CENTER <br />WHEREAS, the owner and potential purchasers of the property located at 730 SOM <br />Center Road, known as the Georgian Center Office Building, have requested the granting <br />of a Special Use Permit to allow medical offices as a permitted use throughout the entire <br />building; and <br />WHEREAS, the property has previously been granted a Special Use Permit for one <br />floor out of the three floors of the building; and <br />WHEREAS, a survey has shown that the parking lot is more than adequate to <br />accommodate such uses, and there are additional parking spaces land banked for use by <br />the building, if needed; and <br />WHEREAS, the Board of Zoning Appeals has granted a variance as to the required <br />number of parking spaces contingent upon the Applicant receiving a Special Use Permit; <br />and <br />WHEREAS, Special Use Permits granted pursuant to 1149.02 and 1153.02 of the <br />Codified Ordinances, have a life span of two years, and can therefore be rescinded and <br />revoked in the event that the use becomes injurious to the surrounding neighborhood or <br />the parking becomes insufficient for medical offices. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Georgian Center located at 730 SOM Center Road, is hereby <br />and herein granted a Special Use Permit for medical offices as a permitted use on the <br />remaining two floors of the office building subject to the two year review period mandated <br />in the Codified Ordinances, and conditioned upon the property owner providing the <br />additional parking from its land bank of available parking spaces should the Village <br />determine that same is necessary. <br />SECTION 2. The Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Resolution have been taken at open meetings of this <br />Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code.
