RESOLUTION NO. 2002- iz <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION AUTHORIZING THE MAYOR <br />AND DIRECTOR OF FINANCE TO SEEK FINANCIAL ASSISTANCE <br />FROM THE TRANSPORTATION ENHANCEMENT PROGRAM <br />AS AND FOR THE FUNDING OF THE WILSON-BETA-S.O.M. <br />MULTI-PURPOSE TRAIL PHASE I AND PHASE II PROJECTS. <br />WHEREAS, pursuant to the Transportation Equity Act for the Twenty-first (21S) <br />Century, the State of Ohio has authorized reimbursement to municipal entities for the <br />purpose of financing public and infrastructure capital improvements as designated by law; <br />and <br />WHEREAS, the Village has determined that it is in the best interest of its residents <br />and it has been deemed necessary by Village Council to submit applications for financial <br />assistance for Transportation Enhancements to promote bicycle and pedestrian traffic <br />along Wilson Mills Road, S.O.M. Center Road, Beta Drive, North Commons Boulevard, <br />Parkview Drive, White Road and the various bike paths and trails adjacent to those <br />roadways. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor is hereby authorized to apply directly to the Northeast Ohio <br />Areawide Coordinating Agency for the following capital infrastructure improvement projects: <br />The Wilson Mills-Beta-S.O.M. Multi-Purpose Trail Project - Phase I <br />The Wilson Mills-Beta-S.O.M. Multi-Purpose Trail Project - Phase II <br />SECTION 2. The iVlayor is further authorized to enter into any agreements as may <br />be necessary and appropriate for obtaining this financial assistance, as approved as to <br />form by the Village Law Director, and in accordance with all authority granted to and <br />limitations upon the Village Director of Finance. <br />SECTION 3. That the Village recognizes and accepts financial responsibility for <br />twenty percent (20%) of the costs of the projects described above, as well as the financial <br />responsibility to maintain the trails after construction. <br />SECTION 4. This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and welfare of the residents <br />of Mayfield Village. It shall, therefore, take effect immediately upon passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />'? Mayor or otherwise at the earliest time allowed by law.
