RESOLUTION NO. 2002-17 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />DECLARING THE NECESSITY AND INTENTION TO APPROPRIATE FOR STREET <br />PURPOSES A FEE SIMPLE INTEREST IN AND TO VARIOUS PREMISES ALONG <br />S.O.M. CENTER ROAD TO FACILITATE ITS WIDENING <br />WHEREAS, in promotion of the public interest of the residents of the Village of <br />Mayfield, it is necessary for the Village to appropriate for street purposes a fee simple <br />interest in and to various premises along S.O.M. Center Road to facilitate its widening; and <br />WHEREAS, in accordance with Ohio Revised Code Section 719.05, only one <br />reading of this Resolution shall be required. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. This Council deems it necessary and declares its intention to <br />appropriate for street purposes a fee simple interest in various premises more fully <br />described in Exhibit A attached hereto and incorporated herein by reference as if fully <br />rewritten. <br />SECTION 2. The Mayor hereby and herein is authorized and directed to cause <br />written notice of the passage of this Resolution to be given to the owners or persons in <br />possession or having an interest of record in the various premises, and that such notice <br />shall be served and returned according to law. <br />SECTION 3. Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Resolution have been taken at open meetings of this <br />Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and welfare of the residents <br />of Mayfield Village. It shall, therefore, take effect immediately upon passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law,1 I/ <br />MLLIAM BUCKHOLTZ <br />Council President
