ORDINANCE NO. 2003-06 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE APPOINTMENT OF <br />JACK PETRONELLI AS AND FOR SPECIAL CONSULTANT <br />ON EMPLOYEE CONTRACTS, WAGES, TERMS AND <br />CONDITIONS OF EMPLOYMENT <br />WHEREAS, the Village is in the process of negotiating employment agreements with <br />the Fraternal Order of Police as and for the Police Department employees, and the Fire <br />Fighters Association, as well as determining the wages, terms and conditions for all <br />employees within the Village; and <br />WHEREAS, the Village has determined that at least with the FOP, that Council <br />negotiations have not been capable of resolving the issues and that arbitration may be <br />necessary pursuant to the terms of the existing Collective Bargaining Agreement before the <br />American Arbitration Association designated neutral; and <br />WHEREAS, pursuant to Article V, Section 4 of the Village Charter, the Mayor may <br />appoint Special Counsel to augment the services of the Law Director, only after the Law <br />_ Director has certified that it is necessary to do so, and that such appointment is confirmed <br />by a majority vote of Council; and <br />WHEREAS, the Law Director has provided appropriate approval and the Mayor has <br />designated for appointment Jack Petronelli from the firm of Johnson & Angelo, to act as <br />Labor Consultant for the purpose of negotiating and/or arbitrating a Collective Bargaining <br />Agreement with the Fraternal Order of Police relevant to their contract for wages, terms and <br />conditions of employment, for the police employees; and <br />WHEREAS, such services may be extended for purposes of negotiating and/or <br />arbitrating an agreement with the Fire Fighters Association, and meeting with any other <br />employee groups wishing to participate in the process for finalizing an Ordinance <br />establishing wages, terms and conditions of employment, for all other non-union employees <br />in the Village. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor's appointment of Jack Petronelli of Johnson & Angelo, <br />as and for negotiating and/or representing the Village in contract discussions and/or <br />arbitration with the Fraternal Order of Police, Fire Fighters Association, or other employee <br />groups, is hereby affirmed effective this date. <br />? <br />, <br />?_
