ORDINANCE NO. 2003-07 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE ADOPTING A STORM WATER <br />MANAGEMENT PROGRAM AND AUTHORIZING THE MAYOR <br />TO SUBMIT SUCH PROGRAM TO THE OHIO ENVIRONIVIENTAL <br />PROTECTION AGENCY. <br />WHEREAS, Council has determined that flooding is a significant threat to the public health, <br />safety and welfare of Mayfield Village residents and public and private property in the Village, <br />and storm water quantity control lessens flood damage by holding runoff and releasing it slowly <br />over time; and <br />WHEREAS, to promote the public health, safety and welfare along with sound economic <br />development in Mayfield Village, it has been deemed important to provide homeowners, <br />developers and land owners with consistent, technically feasible, and operationally practical <br />standards for storm water management; and <br />WHEREAS, the United States Code of Federal Regulations at 40 C.F.R. Parts 9, 122, 123, and <br />124 referred to as the NPDES Storm Water Phase II, mandates that designated communities, <br />including Mayfield Village, develop a Storm Water Management Program to address the quality <br />of storm water runoff during and after soil disturbing activities; and <br />WI-MREAS, Article XVII, Section 3 of the Ohio Constitution grants municipalities the legal <br />authority to adopt rules to abate soil erosion and water pollution by soil sediments; and <br />WHEREAS, Chapter 1511 of the Ohio Revised Code grants municipalities the legal authority <br />to adopt sediment and erosion control practices. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, T'HAT: <br />SECTION 1. Council hereby adopts for implementa.tion the Storm Water Management <br />Program attached hereto and incorporated herein as Exhibit A and that the Mayor be and is <br />hereby authorized to submit the Storm Water Management Program to the Ohio Environmental <br />Protection Agency for its review and approval. <br />SECTION 2. The Council finds and determines that all formal actions of this Council relating <br />to the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code.
