ORDINANCE NO. 2003-1)(AS AMENDED) <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINAfVCE <br />AUTHORIZING THE MAYOR TO ENTER INTO A PURCHASE AGREEMENT <br />WITH EDWARD R. FALKNER, AS TRUSTEE OF THE EDWARD R. FALKNER TRUST <br />DATED OCTOBER 7, 1991, AS AND FOR THE ACQUISITION OF A PART <br />OF THE REAL ESTATE LOCATED AT 710 S.O.M. CENTER ROAD, <br />REFERRED TO AS PARCEL 1 <br />WHEREAS, the Village of Mayfield finds it in its best interest to acquire the property <br />located at 710 S.O.M. Center Road; and <br />WHEREAS, Edward R. Falkner, as Trustee of the Edward R. Falkner Trust Dated <br />October 7, 1991, is the current owner of a parcel of land also known as Permanent Parcel <br />Number 831-13-005, and a part of which is referred to as Parcel 1. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, COUNTY OF CUYAHOGA AND STATE OF OHIO, THAT: <br />SECTION 1. The Mayor is authorized and directed to enter into a purchase <br />, agreement in a form substantially similar to that attached hereto and incorporated herein <br />as, Exhibit "A" with Edward R. Falkner, as Trustee of the Edward R. Falkner Trust Dated <br />October 7, 1991 for Parcel 1. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law.
