Flpr 17 03 01: i <br />'17p Diemert & Rss,sociates (440)442-0825 <br />ORDINANCE NO. 2003- P 4 INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO A PURCHASE AGREEMENT <br />WITH KENIVETH E. ZAKO AS AND FOR THE ACQUlS1TION <br />OF REAL ESTATE LOCATED AT 470 S.O.M. CENTER ROAD <br />WHEREAS, the Village of Mayfield finds it in its best interest to acquire the property <br />located at 470 S.O.M. Center Road; and <br />WHEREAS, Kenneth E. Zako is fihe current owner of the parcel of land also known <br />as Permanent Parcel Number 831-09-004. <br />NOV1l, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, COUNTY OF CUYAHOGA AND STATE OF OHIO, THAT: <br />SECTION 1. The Mayor is authorized and directed to. enter into a purchase <br />agreement in a form substantially similar to that attached hereto and incorporated herein <br />as, Exhibit "A" with Kenneth E. Zako. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating fio the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of fihe Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. !t shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />p.2
