ORDINANCE NO. 2003- 26 <br />( INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING THE CODIFIED ORDINANCES OF THE VILLAGE OF MAYFIELD <br />LOWERING THE PROHIBITED CONCENTRATION OF ALCOHOL <br />SO AS TO CONFORM TO THE STATE OF OHIO MANDATES <br />WHEREAS, the State legislature has amended Section 4511.19 ofthe Ohio Revised <br />Code effective July 1, 2003 lowering the prohibited concentration of alcohol in a person's <br />blood, breath or urine as it relates to the crime of driving or being in physical control while <br />under the influence of alcohol; and <br />WHEREAS, the Village of Mayfield wishes to amend its Codified Ordinances to <br />conform to the amendment adopted by the State legislature which will be in the best <br />interest of the health, safety and welfare of all Village residents. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Section 333.01 of the Codified Ordinances of the Village of Mayfield <br />is amended as set forth in Exhibit A which is attached and incorporated into this ordinance. <br />SECTION 2. The remainder of the Codified Ordinances of the Village of Mayfield <br />shall remain as presently drafted unless inconsistent with this amendment. <br />SECTION 3. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law.
