<br />ORDINANCE NO. 2003- 37 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING CHANGE ORDER NO. 1 TO THE CONTRACT <br />WITH GREAT LAKES CONSTRUCTION, INC. WITH REGARDS TO <br />THE SOM CENTER ROAD WIDENING PROJECT. <br />WHEREAS, the Village of Mayfield has previously entered into a contract with Great <br />Lakes Construction, Inc. with regards to the SOM Center Road Widening Project; and <br />WHEREAS, the Mayor and Council wish to approve Change Order No. 1 to this <br />contract in net the amount of Two Hundred Thousand Dollars ($200,000.00) authorizing <br />installation of landscaped medians consistent with the engineering drawings presented to <br />Mayor and Council which are incorporated by reference subject to the final engineering <br />approval. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Change Order No.1 to the contract with Great Lakes Construction, Inc. <br />with regards to the SOM Center Road Widening Project is approved in the net amount of <br />Two Hundred Thousand Dollars ($200,000.00) authorizing the installation of landscaped <br />medians consistent with engineering drawings presented to the Mayor and Council and <br />which are incorporated by reference into this ordinance and that this entire change order <br />is conditioned upon and subject to final engineering approval. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of tfiis Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including,the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law.
