ORDINANG,E NO. 2003- 44 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CREATING SECTION 131.10 <br />RELATIVE TO THE AUTHORIZATION TO EXPEND PUBLIC FUNDS <br />FOR THE PURCHASE OF FOOD AND BEVERAGES <br />WHEREAS, the Auditor of the State, Betty Montgomery pursuant to Bulletin 2003- <br />005 has requested that all municipal entities within the State memorialize by a duly enacted <br />ordinance or resolution having prospect affect only, the expenditure of public funds forfood <br />and beverage purchases; and <br />WHEREAS, Village Council wishes to comply with the Auditor's Bulletin by enacting <br />Codified Ordinance Section 131.10. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 131.10 of the Codified Ordinances be herein enacted to <br />read as follows: <br />131.10 Food and Beverage Purchases for Meetings and <br />Fund-Raisers <br />The Mayor is hereby authorized to purchase food and <br />beverages for meetings of any public body, board, commission, <br />public officer(s) or public employee(s), and fund-raising events <br />for obtaining money for the General Fund, whenever such <br />meetings and/or fund-raisers are for the purpose of benefitting <br />the taxpayers of the Village, either by way of raising additional <br />monies for the General Fund or some special fund of the <br />Village, or for conducting public business, all of which shall be <br />considered as the furthering of a public purpose. The Mayor <br />shall be authorized to spend not more than that amount <br />authorized by Council in the budget from year to year, without <br />additional approval needed from Council, for food and <br />beverage purchases. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code.
