ORDINANCE NO. 2001-32 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING THE ZONING CLASSIFICATION <br />OF PERMANENT PARCEL NOS. 831-37-008, 831-37-009 AND 831-37-010 <br />LOCATED IN MAYFIELD VILLAGE FROM RESIDENTIAL <br />TO LOCAL BUSINESS AND SUBMISSION TO <br />THE ELECTORATE AT THE NEXT GENERAL <br />OR REGULARLY SCHEDULED PRIMARY OR SPECIAL ELECTION. <br />WHEREAS, a request has been presented to Village Council seeking to re-zone <br />three specific parcels located on Wilson Mills Road in the Village of Mayfield from <br />residential to general business as defined in Chapter 1165 of the Codified Ordinances of <br />the Village of Mayfield; and <br />WHEREAS, Council deems this amendment in the best interest of the health, safety <br />and welfare of all Village residents in that such re-zoning will promote improvements that <br />will help-define a town center which will be both economically and aesthetically beneficial. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Permanent Parcel Nos. 831-37-008, 831-37-009 and 831-37-010 <br />located in the Village of Mayfield, Cuyahoga County, State of Ohio are re-zoned from <br />residential to local business as defined in Chapter 1165 of the Codified Qrdinances of the <br />Village of Mayfield, conditioned upon a report and recommendation of the Planning and <br />Zoning Commission and approval by the electorate as mandated by Article I I I, Sections 11 <br />and 13, respectively. <br />SECTION 2. That this matter shall be submitted for report and recommendation to <br />the Planning and Zoning Commission as set forth in Article III, Section 11 of the Charter <br />of the Village which shall be acted upon within 90 days from the date of referral. <br />SECTION 3. That upon receipt of the report and recommendation of the Planning <br />and Zoning Commission, and approval of this ordinance by Council, this ordinance shall <br />be referred to the electorate of the Village for approval pursuant to Article I 11, Section 13 of <br />the Charter and pursuant to all other applicable Charter and ordinance provisions. <br />SECTION 4.That the Director of Law is authorized and directed to undertake any <br />and all necessary actions for the submission of this ordinance to the electorate at the next <br />general or regularly scheduled primary or special election to be held in Mayfield Village <br />more than 60 days after the approval of this ordinance by Council, and is further directed <br />to draft ballot language as necessary to carry out the intent of this ordinance.
