ORDINANCE NO. 2001-15 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR <br />TO ENTER INTO A JOINT AGREEMENT ON BEHALF OF THE <br />VILLAGE OF MAYFIELD WITH VARIOUS MUNICIPALITIES <br />TO FORM A JOINT MUNICIPAL IMPROVEMENT CONSORTIUM <br />PURSUANT TO OHIO REVISED CODE SECTION 715.02 <br />WHEREAS, this Ordinance constitutes an emergency measure necessary for the <br />preservation of the public peace, property, health and safety, and provided it receives the <br />affirmative vote of two-thirds (2/3) of the members elected to Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor; otherwise it shall <br />take effect and be in force from and after the earliest period allowed by law; and <br />WHEREAS, Section 715.02 of the Ohio Revised Code provides for two or more <br />municipal corporations entering into an agreement for the joint construction or <br />management, or construction and management, of any public work, utility or improvement, <br />benefitting each such municipal corporation or for the joint exercise of any power conferred <br />on municipal corporations by the constitution or laws of the State of Ohio; and <br />WHEREAS, law requires that all contracts for public improvements shall be entered <br />into only with the lowest and best bidder after public competitive bidding; and <br />WHEREAS, a substantial cost savings could be realized by joining with the <br />surrounding municipalities for the biding of public contracts for public improvements, works <br />and repairs as well as for various public contracts for services necessary for these <br />municipalities; and <br />WHEREAS, Council desires to authorize the Mayor to enter into an agreement with <br />certain municipalities in order to form a joint consortium for the purpose of bidding public <br />contracts. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby authorized to enter into an agreement on <br />behalf of the Village of Mayfield with other municipalities for the purpose of forming a joint <br />municipal improvement consortium. The terms of the joint agreement are attached hereto <br />and incorporated herein and marked as "Exhibit A."
