f <br />M1r <br />ORDINANCE NO. 2001- 21 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AMENDING SECTION 521.12 (b) <br />OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE TO PROHIBIT <br />PERSONS FROM DEPOSITING CURBSIDE GARBAGE <br />NOT GENERATED FROM THE PREMISES <br />WHEREAS, it has been deemed necessary and in the best interest of the <br />residents and inhabitants of the Village of Mayfield to amend Section 512.12 (b) of the <br />Codified Ordinances of the Village to prohibit any person from depositing curbside <br />garbage not generated from the premises. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Section 521.12 (b) of the Codified Ordinances of the Village of <br />Mayfield is hereby and herein amended to read as follows: <br />521.12 GURBSIDE GARBAGE DEPOSIT; REGULATIONS. <br />(b) No person shall place an y ,qarbage, rubbish, or other refuse intended <br />for trash pick-up unless such garbage, rubbish, or refuse is generated <br />from the premises. <br />No person shall remove, appropriate, or otherwise take any garbage, <br />rubbish, or other refuse deposited on or around tree lawns for collection of <br />the residential curbside recycling program except for authorized agents of <br />the municipality. <br />* <br />SECTION 2. That all other Codified Ordinances of the Village of Mayfield shall <br />remain as presently drafted unless inconsistent with this amendment. <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in compliance with all <br />statutory requirement$ including the requirements of Section 121.22 of the Ohio <br />Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />?. Village, Ohio.
