ORDINANCE NO. 2001- 29 <br />, INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />APPROVING A CERTAIN LOT SPLIT AND RELATED EASEMENTS <br />FOR PROPERTY OWNED BY ALTERCARE OF MAYFIELD <br />WHEREAS, the Planning Commission on December 3, 2001 approved a lot split and <br />related easements for property owned by AlterCare and more specifically known as <br />Permanent Parcel No. 831-04-04, the same being attached hereto and incorporated herein <br />by reference as Exhibit A; and <br />WHEREAS, such lot split and related easements will enhance the development of <br />the AlterCare property and benefit the citizens of the Village of Mayfield. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The lot split and related easements, forAfterCare of Mayfield, attached <br />hereto and incorporated herein as Exhibit A, and pertaining to Permanent <br />Parcel No. 831-04-04, are hereby and herein approved. <br />Section 2. The Clerk is authorized to cause such plat and related easements to be <br />recorded with the appropriate Village and/or local government agencies, as determined by <br />- the Village Engineer after same is executed by all appropriate officials and bodies. <br />SECTION 3. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />/ A// 7 L';>/ <br />17VILLIAM ?JKQ[ <br />Council Pdent
