Upon the effective date of this agreement, or <br />within thirty (30) days thereafter, ali employees in the bargaining <br />unit shall either become due-paying members of the F.O.P., or, as a <br />condition of continued employment, remit to the F.O.P., a fair <br />share fee, to be determined .in accord with the provisions of Ohio <br />Revised Code Section 4117.09 (C). Any newly hired employees in the <br />bargaining unit shall, upon completion of sixty (60) days of <br />employment with the Employer, either elect to become members of the <br />F.O.P. or remit the fair share fee. Nothing in this Article shall <br />be deemed to require any employees to become a member of the F.O.P: <br />The payment of union dues or a fair sham fee does not in any way <br />affect the Employer's rights as detailed in Article 7 below. <br />Section 3.2. The Employer agrees to deduct F.O.P. dues from any <br />F.O.P, member of the bargaining unit who provides written <br />authorization for a payroll dues deduction. Fair share fees shall <br />be deducted pursuant to Ohio Revised Code Section 4117.09 (C) and <br />the F.O.P. shall indemnify the Employer and hold it harmless <br />against any and all claims, demands, suits or other liability that <br />may arise by reason of any action of the Employer in complying with <br />the provisions of this Article. <br />Deductions for dues and fair share fees will be made at least on a <br />monthly basis and paid to Treasurer, F.O.P. Lodge #57 (Mayfield <br />Village Division) with -the Employer providing a List of those <br />employees for whom dues and fair share fee deductions have been <br />made. <br />Section. 3.3. A check in the amount of the total dues withheld <br />from those employees authorizing a dues deduction shall be ter_dered <br />to the Treasurer of the F.O.P. within fifteen (IS} days from the <br />date of making said deductions. <br />Page 5 of 43 <br />
