<br />AN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE
<br />CONSTRUCTION OF NORTH COMMONS BOULEVARD AND
<br />PARKVIEW .DRIVE, EACH BETWEEN CERTAIN TERMINI, BY
<br />GRADING, DRAINING, EXCAVATIlVG, PAVING WITH
<br />CONCRETE AND CONSTRUCTING A BICYCLE PATH, CURBS,
<br />WATER MAINS, SANITARY SEWERS, SERVICE CONNECTIONS,
<br />VALVES, FIRE HYDRANTS, STORM SEWERS, CATCH BASINS,
<br />MANHOLES AND VAULTS, TOGETHER WITH THE NECESSARY
<br />APPURTENANCES THERETO, AND DECLARING AN
<br />EMERGENCY.
<br />WHEREAS, the improvement described in Section 1 has been completed, the final
<br />cost of that improvement has been determined, and the final special assessments for that
<br />improvement have been determined in accordance with {i) the Petition of Progressive Casualty
<br />insurance Company (Progressive) for this improvement dated October 2b, 1998 (the Petition)
<br />presented to, and accepted by, this Council; (ii) Resolution No. 98-I7 adopted on November 9,
<br />1998 (the Resolution); and (iii) Ordinance No. 98-38 passed on November 9, 1998 (collectively,
<br />the Prior Proceedings); and
<br />WHEREAS, Progressive, as the sole owner of the property to be assessed for this
<br />improvement, has, by the Petition, waived any notice of this ordinance under Revised Code
<br />Section 727.26 and has also indicated to the Director of Finance that it has opted to pay such
<br />assessment over a twer~.y-year period with interest at the rate of 5% per year which is the
<br />maximum rate on the loan obtained by the Village from the State for this improvement pursuant to
<br />a Loan Agreement dated as of November 2S, 1998 between the Village and the Director of
<br />Transportation of the State of Ohio (the State Loan);
<br />NOW, T'HERE1; ORE, BE IT ORDAINED by the Council of Mayfield Village,
<br />Cuyahoga County, Ohio, that:
<br />S 'on 1. The special assessments for the cost and expense of constructing a road
<br />known as North Commons Boulevard in Mayfield Village, from White Road at a point
<br />approximately 1,000 feet west of the intersection of White Road with S.O.M. Center Road
<br />thence south approximately 2,825 feet and terminating at a point located at the property line of
<br />the property formerly known as the Associated Estates property and from there, a second road
<br />known as Parkview Drive, approximately 610 feet east and terminating at the intersection of
<br />Parkview Drive with S.O.M. Center Road by grading, draining, excavating, paving with
<br />concrete and constructing a bicycle path, curbs, water mains, sanitary sewers, service
