351.13 TRAFFIC CODE 92 <br />(d) The design and total number of parking spaces for the handicapped provided under <br />subsection (a) hereof, shall be determined in accordance with the Ohio Basic Building Code as <br />adopted by Section 1329.01 of the Codified Ordinances. <br />(Ord. 89-15. Passed 4-17-89.) <br />(e) As used in this section: <br />(1) "Handicapped person" means any person who has lost the use of one or <br />both legs, or one or both arms, who is blind, deaf or so severely <br />handicapped as to be unable to move without the aid of crutches or a <br />wheelchair, or whose mobility is restricted by a permanent cardiovascular, <br />pulmonary or other handicapping condition. <br />(2) "Person with a disability that limits or impairs the ability to walk" has the <br />same meaning as in Ohio R.C. 4503.44. <br />(3) "Special license plates" and "removable windshield placard" mean any <br />license plates or removable windshield placard or temporary removable <br />windshield placard issued under Ohio R.C. 4503.41 or 4503.44, and also <br />mean any substantially similar license plates or removable windshield <br />placard or temporary removable windshield placard issued by a state, <br />district, country or sovereignty. (ORC 4511.69) <br />(f) It shall be an affirmative defense to any offense charged under subsection (c) hereof <br />that the party so charged is handicapped as defined in this section. <br />(g) The violation of any provision of this section shall be a misdemeanor of the third <br />degree. Passed 11-16-81.) <br />351.13 PARKING ON FRONT YARDS OR TREE LAWNS. <br />(a) No person or property owner shall, at any time, park, or store, or permit to be <br />parked or stored, on residential property, any motor vehicle, truck, tractor-trailer, motorcycle, <br />trailer, bus, boat or other vehicle, between the residential setback line and the public right of way, <br />except on the driveway and/or lawful turn-around area. <br />(Ord. 99-35. Passed 10-18-99.) <br />(b) Vehicles parked in such areas for the purpose of selling must be owned by a <br />resident of the premises upon which such vehicle is parked. <br />(c) No vehicle shall be parked, for the purpose of selling, for more than fourteen days. <br />No person shall display more than two vehicles on any premise during any twelve-month period. <br />(d) Signs shall be limited to no more than a total of six square feet in area and must be <br />placed inside the windows of the vehicle. Vehicles without windows may place a single sign no <br />larger than six square feet in area. (Ord. 97-13. Passed 3-17-97.) <br />351.99 PENALTY. <br />(a) Whoever violates Section 351.03(d), (i) or (q) shall be fined ten dollars ($10.00) <br />if such fine is paid within forty-eight hours after such violation; a violation of Section 351.03(s) <br />shall be fined forty dollars ($40.00) within the same time frame. <br />(b) Whoever violates Section 351.03(d), (i) or (q) shall be fined twenty dollars ($20.00) <br />if such fine is paid after forty-eight hours and before seventy-two hours after such violation; a <br />violation of Section 351.03(s) shall be fined fifty dollars ($50.00) within the same time frame. <br />(Ord. 95-23.
