351.13 TRAFFIC CODE 92 (d) The design and total number of parking spaces for the handicapped provided under subsection (a) hereof, shall be determined in accordance with the Ohio Basic Building Code as adopted by Section 1329.01 of the Codified Ordinances. (e) As used in this section: (1) "Handicapped person" means any person who has lost the use of one or both legs, or one or both arms, who is blind, deaf or so severely handicapped as to be unable to move without the aid of crutches or a wheelchair, or whose mobility is restricted by a permanent cardiovascular, pulmonary or other handicapping condition. (2) "Person with a disability that limits or impairs the ability to walk" has the same meaning as in Ohio R.C. 4503.44. (3) "Special license plates" and "removable windshield placard" mean any license plates or removable windshield placard or temporary removable windshield placard issued under Ohio R.C. 4503.41 or 4503.44, and also mean any substantially similar license plates or removable windshield placard or temporary removable windshield placard issued by a state, district, country or sovereignty. (ORC 4511.69) (f) It shall be an affirmative defense to any offense charged under subsection (c) hereof that the party so charged is handicapped as defined in this section. (g) The violation of any provision of this section shall be a misdemeanor of the third degree. (Ord. 81-59. Passed 11-16-81.) 351.13 PARKING ON FRONT YARDS OR TREE LAWNS. (a) No person or property owner shall, at any time, park, or store, or permit to be parked or stored, on residential property, any motor vehicle, truck, tractor-trailer, motorcycle, trailer, bus, boat or other vehicle, between the residential setback line and the public right of way, except on the driveway and/or lawful turn-around area. (Ord. 99-35. Passed 10-18-99.) (b) Vehicles parked in such areas for the purpose of selling must be owned by a resident of the premises upon which such vehicle is parked. (c) No vehicle shall be parked, for the purpose of selling, for more than fourteen days. No person shall display more than two vehicles on any premise during any twelve-month period. (d) Signs shall be limited to no more than a total of six square feet in area and must be placed inside the windows of the vehicle. Vehicles without windows may place a single sign no larger than six square feet in area. (Ord. 97-13. Passed 3-17-97.) 351.99 PENALTY. (a) Whoever violates Section 351.03(d), (i) or (q) shall be fined ten dollars ($10.00) if such fine is paid within forty-eight hours after such violation; a violation of Section 351.03(s) shall be fined forty dollars ($40.00) within the same time frame. (b) Whoever violates Section 351.03(d), (i) or (q) shall be fined twenty dollars ($20.00) if such fine is paid after forty-eight hours and before seventy-two hours after such violation; a violation of Section 351.03(s) shall be fined fifty dollars ($50.00) within the same time frame.
