ORDINANCE NO. 2000-37 (AS AMENDED) <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO <br />GRANT TO TELERAMA, INC. A FRANCHISE AGREEMENT FOR THE PERIOD OF <br />TEN (10) YEARS FOR THE PURPOSE OF PROVIDING CABLE TELEVISION <br />SERVICES TO THE VILLAGE OF MAYFIELD <br />WHEREAS, the Village of Mayfield has found and determined that the public <br />necessity and convenience will be served and has been served by the installation and <br />maintenance of a Cable television system in the Village of Mayfield; and <br />WHEREAS, Telerama, Inc. and the Village of Mayfield have engaged in informal <br />renewal negotiations; and <br />WHEREAS, the Village of Mayfield after full consideration finds that Telerama, <br />Inc. as well as its successor in interest, Western Reserve Cablevision, Inc. represents <br />and acknowledges it is capable and agreeable to provide Cable television services to <br />the Village of Mayfield; and <br />WHEREAS, the Village of Mayfield has determined that the financial, legal and <br />technical ability of Telerama, Inc. and its successor in interest, Western Reserve <br />Cablevision, Inc. is reasonably sufficient to provide services, facilities, and equipment <br />necessary to meet future Cable related needs and interests of its residents; and <br />WHEREAS, the Village of Mayfield, after due evaluations, has determined that it <br />is in the best interest of the Village of Mayfield and its residents to grant a new franchise <br />to Telerama, Inc. for the term of ten (10) years; and <br />WHEREAS, said agreement between the Village of Mayfield and Western <br />Reserve Cablevision, Inc. is incorporated herein and made a part of this ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. A renewal of the existing franchise to construct, reconstruct, <br />operate and maintain a Cable communications system within the boundaries of the <br />Village of Mayfield, subject to all provisions of the agreement in a form substantially <br />similar to that attached hereto and made a part hereof as Exhibit A, be awarded to <br />Telerama, Inc. for a period of ten (10) years. <br />SECTION 2. The Mayor and the Finance Director, hereby are authorized and <br />directed to enter into the franchise agreement substantially similar to that attached <br />hereto and incorporated herein; with Telerama, Inc. <br />ORDINANCE NO. 2000- <br />
