5~..~ aw.nti,&er~-~- ORDINANCE NO. 2000--~=.37 ~" ~,_ ~~ INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO GRANT TO CABLEVISION OF THE MIDWEST, INC. A FRANCHISE AGREEMENT FOR THE PERIOD OF TEN (10) YEARS FOR THE PURPOSE OF PROVIDING CABLE TELEVISION SERVICES TO THE VILLAGE OF MAYFIELD WHEREAS, the Village of Mayfield has found and determined that the public necessity and convenience will be served and has been served by the installation and maintenance of a Cable television system in the Village of Mayfield; and WHEREAS, Cablevision of the Midwest, Inc. and the Village of Mayfield have engaged in informal renewal negotiations; and WHEREAS, the Village of Mayfield after full consideration finds that Cablevision of the Midwest, Inc. as well as its successor in interest, Western Reserve Cablevision, Inc. represents and acknowledges it is capable and agreeable to provide Cable television services to the Village of Mayfield; and WHEREAS, the Village of Mayfield has determined that the financial, legal and technical ability of Cablevision of the Midwest, Inc. and its successor in interest, Western Reserve Cablevision, Inc. is reasonably sufficient to provide services, facilities, and equipment necessary to meet future Cable related needs and interests of its residents; and WHEREAS, the Village of Mayfield, after due evaluations, has determined that it is in the best interest of the Village of Mayfield and its residents to grant a new franchise to Cablevision of the Midwest, Inc. for the term of ten (10) years; and WHEREAS, said agreement between the Village of Mayfield and Western Reserve Cablevision, Inc. is incorporated herein and made a part of this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. A renewal of the existing franchise to construct, reconstruct, operate and maintain a Cable communications system within the boundaries of the Village of Mayfield, subject to all provisions of the agreement in a form substantially similar to that attached hereto and made a part hereof as Exhibit A, be awarded to Cablevision of the Midwest, Inc. for a period of ten (10) years. SECTION 2. The Mayor and the Finance Director, hereby are authorized and directed to enter into the franchise agreement substantially similar to that attached hereto and incorporated herein, with Cablevision of the Midwest, Inc.
