ORDINANCE NO. 2000- <br />PAGE 14 <br />(3) List of the partners, general and limited, of the applicant, if a partnership, <br />or the percentage of stock owned or controlled by each shareholder, if a corporation. <br />(4) The names and addresses of any parent or subsidiary of applicant or any <br />other business entity owning or controlling applicant in whole or in part, or owned or <br />controlled in whole or in part by applicant. <br />(5) A current financial statement of the applicant, or such other form of financial <br />information satisfactory to the Grantor, verified by a Certified Public Accountant audit or <br />otherwise certified under oath to be true and accurate by a legal officer of Grantee, <br />complete and correct to the reasonable satisfaction of the Village. <br />(6) Proposed construction and service schedule. <br />(7) Any additional information that the Village deems applicable or necessary. <br />§945.14 CONSIDERATION OF INITIAL APPLICATIONS. <br />(a) Within 60 days of receipt of any application for an initial franchise, the Mayor, <br />or his or her designee, shall prepare a report and make his or her recommendations <br />respecting such application to the Village Council. <br />(b) A public hearing shall be set prior to any initial franchise grant, at a time and <br />date approved by the Village Council within 30 days after the submission of the Mayor's <br />report. Within 60 days after the close of the hearing, the Council shall make a decision <br />based upon the application, the evidence received at the hearing and any other information <br />and/or documents as the Council may consider as to whether or not the franchise(s) should <br />be granted and, if granted, subject to what conditions. The Council may grant one or more <br />initial franchises, or may decline to grant any franchise. <br />§945.15 FRANCHISE RENEWAL. <br />Franchise renewals shall be in accordance with applicable law including, but not <br />necessarily limited to, the Cable Communications Policy Act of 1984, as amended. Grantor <br />and Grantee, by mutual consent, may enter into renewal negotiations at any time during <br />the term of the franchise. <br />§945.16 RATE REGULATION; SENIOR CITIZEN DISCOUNTS; PROMOTIONS; <br />BROADCAST BASIC SERVICE; GUARANTEED SERVICE CALLS. <br />(a) The Village reserves the right to regulate rates for basic cable service and any <br />other services offered over the cable system, to the extent permitted by federal or state law. <br />The Grantee shall be subject to the rate regulation provisions provided for herein, and <br />those of the (FCC) provided at 47 CFR, Part 76.900, Subpart N. <br />
