ORDINANCE NO. 2000 <br />PAGE 18 <br />Grantee shall maintain written records of all results of its cable system tests, <br />performed by or for the Grantee. Such test results shall be made available to Grantor upon <br />request within one week of the submission of the request for same. <br />(g) Grantee shall provide Grantor, thirty (30) days notice of all required FCC Proof <br />of Performance tests. In the event of any FCC test failures FCC procedures shall apply. <br />(h) At any time after commencement of service to subscribers, the Grantor may <br />require where reasonable, additional tests, full or partial repeat tests, different test <br />procedures or tests involving a specific subscriber's terminal. Requests for such additional <br />tests will be made on the basis of complaints received or the evidence indicating any <br />unresolved controversy or noncompliance, and such tests shall be limited to the particular <br />matter in controversy. The Grantor shall endeavor to so arrange its request for such special <br />tests so as to minimize hardship or inconvenience to Grantee or the subscriber. Failure to <br />perform such properly requested additional tests within 30 days shall constitute a material <br />breach of this Chapter. <br />§945.20 TRIMMING OF TREES. <br />(a) Grantee shall have the authority to trim trees, in accordance with all applicable <br />ordinances, utility restrictions, and easement restrictions, upon and hanging over streets, <br />alleys, sidewalks, and public places of the Village so as to prevent the branches of such <br />trees from coming in contact with the wires and cables of Grantee at its sole cost. Village <br />representatives shall have authority to supervise and approve all trimming of trees <br />conducted by Grantee. <br />(b) Except in emergencies, Grantee may not prune trees at a point below 30 feet <br />above sidewalk grade until one week after written notice has been given to the owner or <br />occupant of the premises abutting the street in or over which the tree is growing. For <br />purposes of this section, emergencies exist when it is necessary to prune to protect the <br />public from imminent danger of immediate interruption of cable signal. The owner or <br />occupant shall have one week from the receipt of Grantee's notice to arrange for an outside <br />contractor to prune the tree at his or her own expense. If the owner or occupant fails to do <br />so, Grantee may prune such tree at its own expense. <br />§945.20 PROVISION OF CABLE TO PUBLIC FACILITIES. <br />Grantee shall provide one (1) free standard installation and free monthly expanded <br />basic service, exclusive ofpremium orpay-per-view and a la carte services, to the locations <br />to be listed in an exhibit to the franchise agreement as well as all newly constructed public <br />facilities during the term of the franchise, plus two (2) additional public facility locations <br />selected by Grantor. Such sites may also receive premium and pay-per-view services, <br />consistent with all applicable laws, at a cost not greater than that charged to residential <br />subscribers for the same service. <br />
