ORDINANCE NO. 2000- 38 <br />PAGE 2 <br />945.22 Insurance; construction <br />945.23 Records required and Grantor's right to inspect <br />945.24 Annual reports <br />945.25 Institutional network; interconnection with other government <br /> networks <br />945.26 Public, educational or government (PEG) access channels and <br /> facilities; fee in lieu <br />945.27 Franchise violation <br />945.28 Force majeure; Grantee's inability to perform <br />945.29 Abandonment or removal of franchise property <br />945.30 Extended operation and continuity of service <br />945.31 Receivership and foreclosure <br />945.32 Rights reserved to Grantor <br />945.33 Rights of individuals <br />945.34 Time limits strictly construed <br />945.35 Delegation of authority <br />945.36 Conflicts <br />945.37 Severability <br />§945.01 INTENT. <br />(a) The Village pursuant to applicable federal and state law, is authorized to grant <br />one or more nonexclusive franchises to construct, own, operate, maintain and reconstruct <br />cable television systems within the Village limits. <br />(b) The Village Council finds that the development of cable television systems has <br />the potential of having great benefit and impact upon the residents of the Village. <br />(c) Due to the complex and rapidly changing technology associated with cable <br />television, the Village Council further finds that the public convenience, safety and general <br />welfare can best be served by establishing, to the extent permitted by state and federal law, <br />regulatory powers which should be vested in the Village or such persons, boards, <br />commissions or other entities as the Village shall designate. It is the intent of this chapter <br />and subsequent amendments to provide for and specify the means to attain the best <br />possible cable television service to the public and any franchises issued pursuant to this <br />chapter shall be deemed to include these findings as an integral part thereof. <br />§945.02 DEFINITIONS. <br />For the purpose of this chapter, the following terms, phrases, words and their <br />derivations shall have the meaning given herein. Words used in the present tense include <br />the future, words in the plural number include the singular number, and words in the <br />singular number include the plural number. All capitalized terms used in the definition of <br />any other term shall have their meaning as otherwise defined in this §945.02. The words <br />
