RESOLIJTIOfV {VO. 99-11 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />A RIESOLUTION <br />Al1THORIZING l"HE VILLAGE OF MAYFIELD'S <br />PARTICIPATION IN THE OHIO DE6'ARTIVIENT OF TRAIVSPORTATION <br />COOPERATIVE Pl1RCHASING PROGRAIVI <br />WHEREAS, Section 5513.01(B) of the Ohio Revised Code provides the opportunity <br />for municipal corporations to participate in contracts through the Ohio Department of <br />Transportation (ODOT) forthe purchase of machinery, material, supplies, or other articles; <br />and <br />WFIEREAS, the Village of Mayfield has previously participated in ODOT purchasing <br />programs, wishes to continue to do so in the future, and thus provides this Resolution of <br />Authorization; and <br />WHEREAS, participation in the ODOT Cooperative Purchasing Program is in the <br />best interest of the Village of Mayfield in that the Village is able to obtain machinery, <br />materials, supplies, vehicles, and other articles at extremely competitive rates. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF <br />MAYFIELD, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />Section 1. That the Village Council, through its Mayor, requests authority, in the name <br />of the Village of Mayfield, to participate in the Ohio Department of Transporta#ion contracts <br />for the purchase of machinery, materials, supplies, or other articles which the Department has <br />entered into pursuant to Ohio Revised Code Section 5513.01(B). <br />Section 2. That the Mayor is authorized to agree, in the name of the Village of <br />Mayfield, to be bound by all terms and conditions as the Director of Transportation prescribes. <br />Section 3. That the Mayor is authorized to agree, in the name of the Village of <br />Mayfield, to directly pay vendors, under each such contract of the Ohio Department of <br />Transportation in which the Village of Mayfield participates, for items it receives pursuant to <br />the contract. <br />Section 4. That the Village of Mayfield agrees to hold the Director of Transportation <br />and the Ohio Department of Transportation harmless for any claim or dispute arising out of <br />participation in a contract pursuant to Ohio Revised Code Section 5513.01(B). <br />Section 5. That Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Resolution have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code.
