Dec 10 99 10:50a <br /> <br />Diemert & Rssociates [440)442-0825 p.2 <br />ORDINANCE NO: 99- ~--,5 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING A CHANGE ORDER WITH <br />CAPUTO-MARTINI CONSTRUCTION COMPANY <br />IN AN AMOUNT NOT TO EXCEED $44,500.00 <br />WHEREAS, the contractorfor the municipal pool and bathhouse has submitted its <br />final change order attached hereto and incorporated herein as Exhibit A; and <br />WHEREAS, it is the desire of Council to approve this final change order with <br />Caputo-Martini Construction Company in the amount of $44,500.00. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the final change order with Caputo-Martini Construction <br />Company, attached hereto and incorporated herein as Exhibit A, is hereby and herein <br />authorized in an amount not to exceed $44,500.00 <br />SECTION 2. That the Mayor and Director of Finance are authorized to enter into <br />any agreement for this final change order necessary, and to make payment as called for <br />therein out of the appropriate accounts of the Village. <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of ifs committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />WILLIAM MARQUARDT <br />Council President <br />
