ORDINANCE 99-01 "An ordinance authorizing the widening and improvement of S.O.M. Center Road from Wilson Mills Road to White Road.' Introduced by Mayor Rinker and Council as a Whole. WHEREAS, Mayfield Village has identified the need to widen and improve S.O.M. Center Road from Wilson Mills Road to White Road as soon as time permits thereby relieving its limited capacity and poor physical condition. WHEREAS, Mayfield Village has applied and received approval for funding by the Ohio Department of Transportation (ODOT) of the eligible S.O.M. Center Road project costs in the initial amount of $9.0 million. WHEREAS, Mayfield Village needs to request that the local metropolitan planning agency, NOACA, place the S.O.M. Center Road Project on its Transportation Improvements Plan in order to receive the Federal Funding through ODOT. !/ WHEREAS, Mayfield Village desires that the project move forward on its schedule and under its administration from planning through design and construction and therefore desires to utilize the Local Public Authority (LPA) process that ODOT has developed to provide the project sponsor this alternative to project development. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT Section 1. Mayfield Village hereby approves the construction of the S.O.M. Center Road Improvements and hereby authorizes the Mayor and the Director of Finance of Mayfield Village to request NOACA to place the project on their Transportation Improvements Plan and to execute a Local Public Authority Agreement with the Ohio Department of Transportation to include all phases of project development, including construction of the improvements. Section 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. Section 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law:
