__- _, -ORDINANCE NO. 99- 12 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR TO ENTER INTO A <br />CONTRACT WITH BFI WASTE SYSTEMS OF OHIO, INC. FOR SOLID <br />WASTE COLLECTION, RECYCLING AND DISPOSAL <br />FOR ATHREE-YEAR TERM WITH TWO ONE YEAR OPTIONS <br />WHEREAS, the Village has advertised for bids pursuant to law for solid waste <br />collection and disposal for athree-year term with two one year options; and <br />WHEREAS, sealed bids were received and analyzed by the Village, and the lowest <br />and best bid was determined to be that of BFI Waste Systems of Ohio, Inc. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and directed to enter <br />into a contract with BFI Waste Systems of Ohio, Inc. for waste collection, recycling and <br />disposal for athree-year term with two one year options, pursuant to the terms and <br />conditions set forth in the advertisement for bids, the bid specifications, and the bid of the <br />contractor, and in a format prepared by the Engineer and approved by the Law Director. <br />SECTION 2. The Director of Finance is authorized to make payment for the <br />aforementioned services in the amounts specified by the contract, a copy of which is <br />attached as Exhibit A, out of the appropriate account of the Village. <br />SECTION 3. The Council finds and determines that all formal actions ofthis Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this <br />Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the affirmative vote of not less than <br />five (5) members elected to Council and approval by the Mayor or otherwise at the earliest <br />time allowed by law. <br />_~~` <br />1~'IILLIAM MARQU <br />Council President <br />
